Terms of Service

These terms govern your use of BrightMind, an AI tutoring platform by Elite Way Holdings (South Africa). By creating an account you agree to these terms and our Privacy Policy.

1. Accounts

Parents/guardians create and manage accounts for learners under 18 and consent to data processing on their behalf. Tutors must be 18+, provide accurate qualifications, and complete verification before earning. One person, one account — keep your login details private.

2. Subscriptions & billing

AI access is sold as monthly plans (prices on the pricing page). Plans renew automatically each month; failed payments pause access until resolved, and we retry daily. Cancel anytime — access continues until the end of the paid period. Tutor sessions, classes and courses are billed separately as shown at booking. All payments are processed securely by Yoco in rand (ZAR).

3. Tutor sessions & marketplace

BrightMind connects families with independent tutors. We verify tutor identities and qualifications, but tutors deliver lessons as independent providers. Session fees split 70% tutor / 30% platform; tutor earnings become available on session completion, with cash-outs (min R200) reviewed by our team. Report no-shows or problems to support promptly so we can help.

4. Acceptable use

Use BrightMind to learn — not to cheat: don't submit AI answers as your own where your school forbids it, share accounts, scrape the platform, upload unlawful content, or attempt to breach security. We may suspend accounts that abuse the platform, with reasons provided in-app.

5. AI limitations

Our AI explains, marks and plans — but it can make mistakes. Treat AI output as a study aid, not a textbook: verify important facts, and note that marking is guidance, not an official school assessment. Fair-use limits apply per plan (shown in-app); heavy automated use may be throttled.

6. Liability

We work hard to keep BrightMind accurate and available, but the service is provided "as is". To the maximum extent allowed by South African law, Elite Way Holdings is not liable for indirect losses (e.g. exam outcomes). Nothing here limits rights you hold under the Consumer Protection Act.

7. Changes, law & contact
